Criminal Law Appeal Cases

State v. Gregorie, 339 S.C. 2, 528 S.E.2d 77 (2000).

Our office represented one of the parties on the appeal.

Defendant driver was charged with speeding and at trial the arresting officer failed to introduce any evidence of the applicable speed limit. The Trial Court convicted defendant, and the first Appellate Court ordered a new trial. Ultimately, the matter reached the South Carolina Supreme Court which held that a second trial would violate Defendant’s double jeopardy rights.

Gregorie v. Goins D.C.S.C., Civil Action 6:05-0822-HFF (March 29, 2007) Affirmed on appeal.

 

Our office represented one of the parties in this suit.

 

This was a civil rights action arising out of event surrounding a police stop for an alleged DUI. The court exonerated the Defendants in the matter, and was affirmed on appeal to the Fourth Circuit Court of Appeals.
