Child Custody

The Court of Appeals noted that divided custody is disfavored by the Supreme Court, although joint custody is now permitted. Bolick v. Bolick, 376 Se 2d 785,(Ct. App. 1989).

There is a rebuttable presumption that the right to custody of their minor child automatically reverts to the surviving parent when the custodial parent dies. Oehler v. Clinton. 317 S.E.2d 445 (Ct. App.1984).
