Alimony

RETROACTIVE ALIMONY

The Family Court has jurisdiction to order retroactive alimony. The Family Court award of retroactive increase in alimony for one month was affirmed in Thornton v. Thornton, 492 S.E.2d 86 (1997). The opinion says in part “(t) he decision to order retroactive support rests with the sound discretion of the family court and should not be reversed absent an abuse of discretion of the family court“, citing Hallums v. Hallums, 296 S.C. 195, 371 S.E.2d 525 (1988).
